No need to get emotional about this. Let me ask you if you buy a firearm in California from a private party is that illegal? Say via craigslist or wherever? When you purchase firearms in said there is no way in knowing it was stolen.
I'm pretty sure all private party firearm sales have to go through a licensed dealer and are subject to the usual provisions of the law. In other words, craigslist and classified ad type private sales are illegal.

Nope. I mean, some states have laws on the books but nothing federal.

A .40 for Aldon? That’s really really high. I have seen 3 cases in the 40s in my entire career and each of those were women who weighed like 110 pounds.

.20-.30 is sloppy

.30 and over is usually drooling wet your pants drunk.

My father recently got a DWI. He blew a .30 and can barely hold his alcohol. Blowing a .40 is just insane.

My father recently got a DWI. He blew a .30 and can barely hold his alcohol. Blowing a .40 is just insane.

Seems like he's an irresponsible guy and a menace to other drivers and pedestrians on the road.

There is a lot of variance in different body types - not only that - some people can hold a .20 a lot better than others can hold a .07.

No one can hold a .40 - it’s out of the ballpark.

If I were trying to be diplomatic ... I might say:

I hope he is OK or He is fortunate no one was hurt

But, really, we don’t know anything about it. In most states, you can get a DWI in a parked car if it’s running. You can get one on a bicycle in my state. On a lawnmower, on a golf cart, in a parking lot, etc.

Jumping right to irresponsible and menace is hardly diplomacy in my mind.

Anyway - it is dangerous stuff - I have seen too many horror stories to gloss over it. I just feel like our tendency to want to judge and condemn is a bit quick too often.

Well, we do know that Aldon Smith just happens to be a 3 time DUI offender, with one of those including hit and run and vandalism charges. So, we don't have to be that diplomatic with Aldon Smith.

I think it's safe to say that unless he gets help AND actually follows it, Aldon is highly likely to die young - either in a car wreck or liver failure. Hopefully he doesn't take anybody with him.

What Is BAC?

Blood Alcohol Concentration (BAC) refers to the percent of alcohol (ethyl alcohol or ethanol) in a person's blood stream. A BAC of .10% means that an individual's blood supply contains one part alcohol for every 1000 parts blood.

In California, a person is legally intoxicated if he/she has a BAC of .08% or higher.

Factors that determine BAC
  • Number of standard drinks (see below)
  • Amount of time in which drinks are consumed
  • Body weight
  • Biological Sex
  • Medications
  • Food (to a lesser extent)
One standard drink
  • One 12 oz. regular beer (4.5% alcohol)
  • One 7 oz. malt liquor (7% alcohol)
  • One 5 oz. glass of wine (12% alcohol)
  • One 1.5 oz. shot of hard liquor (40% alcohol)
  • One-third jigger (.5 oz.) of Everclear (95% alcohol)
More than one standard drink
  • One 16 oz. cup of beer = 1.4 drinks
  • One 40 oz. beer = 3.6 drinks
  • One 22 oz. malt liquor = 3 drinks
  • One 12 oz. glass of wine = 2.9 drinks
  • One 12 oz. margarita = 2–4 drinks, depending on ingredients
  • One 12 oz. cup of trashcan punch = 4–10 drinks, depending on ingredients
Effects of alcohol at various Blood Alcohol Concentration levels
BAC Physical and Mental Effects

.01 - .03 - No apparent effects. Slight mood elevation. In California, you will test as legally impaired at .01% BAC if you are under 21. It is illegal to drive or bike at this level.

.04 - .06 - Feeling of relaxation. Sensation of warmth. Minor impairment of reasoning and memory.

.07 - .09 - Mild impairment of balance, speech, vision and control. In California, you will test as legally impaired at .08% BAC if you are over 21. It is illegal to drive or bike at this level.

.10 - .12 - Significant impairment of motor coordination and loss of judgment. Speech may be slurred.

.13 - .15 - Gross impairment of motor control. Blurred vision and major loss of balance. Onset of dysphoria (anxiety, restlessness).

.16 - .20 - Dysphoria(a state of unease or generalized dissatisfaction with life) predominates. Nausea may appear. Drinker has the appearance of “sloppy drunk.”

.25 - .30 - Severe intoxication. Needs assistance walking. Mental confusion. Dysphoria with nausea and some vomiting.

.35 - .40 - Loss of consciousness. Brink of coma.

.40 and up - Onset of coma. Likelihood of death due to respiratory failure.

When you hear the term years in prison or jail in the legal system. They are usually referring to max time per charge. For example you could serve up to 6 months in jail for littering in California. However in pretty much all cases the full extent of the punishment is rarely served.
